Feb 27, 2025MINUTE entry before the Honorable Edmond E. Chang: Video status hearing held. Counsel for the parties appeared by video. (1.) The dismissal motion argues that there is no supplemental jurisdiction over Counts 6 and 8, which are state law claims involving Dr. Katona. On preliminary review, the argument is solid, so discovery shall **not** commence on those two claims. Having said that, as discussed during the status hearing, if diversity jurisdiction exists, then the only potential obstacle would be joinder, not jurisdiction. It did not seem that there was diversity of citizenship (the amount in controversy seems satisfied), but after some discussion, it is best to confirm, because it would moot the supplemental-jurisdiction argument. The parties shall confer over their LLC-membership citizenship to check if there is diversity (at least as between the LLC parties). ***The parties shall file a status report on that issue by 03/14/2025.*** (2.) The Plaintiff reported that it has hired a second skip tracer as to Defendant Davis. The Plaintiff shall serve Davis by 04/11/2025, or else move for an extension or for alternative means 04/04/2025. The Court does expect that Davis should be found and served personally (unless he is evading service). (3.) By 03/14/2025, the parties shall file a joint new proposed fact discovery schedule on the patent claim, complying with the Northern District of Illinois Local Patent Rules. (4.) Discovery supervision is referred to the magistrate judge (including the authority to adjust all deadlines). No early summary judgment motion may be filed before the close of fact and expert discovery without leave of court. (5.)
