Nov 12, 2024MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff's motion 11 to strike and for entry of default. On January 18, 2024, Plaintiff AOB Products Company filed a complaint for patent infringement against Defendant Nanyang Jianling Trading Co., Ltd. Rather than answer the complaint, Defendant filed via email, pro se, an "Amended Complaint" 10 . That filing was improper. Under Rule 8(b) of the Federal Rules of Civil Procedure, in responding to a complaint, unless asserting defenses, a Defendant must file an answer which "admit[s] or den[ies] the allegations asserted against it by an opposing party." In addition, Defendant's pro se filing was improper because "[a] corporation is not permitted to litigate in a federal court unless it is represented by a lawyer licensed to practice in that court." United States v. Hagerman, 545 F.3d 579, 581 (7th Cir. 2008). Accordingly, Plaintiff's motion 11 is granted in part. Defendant's improper submission 10 is stricken. Defendant has until December 2, 2024 to obtain a lawyer, appear through counsel, and file an answer to Plaintiff's Complaint. If Defendant does not comply, Defendant will be held in default. Dec 16, 2024MINUTE entry before the Honorable John F. Kness: Before the Court is Plaintiff's motion [Dkt. 15] for entry of default against Defendant Nanyang Jianling Trading Co. Ltd. The Court previously informed Defendant that a company cannot appear pro se and gave Defendant until December 2, 2024 to obtain a lawyer, appear through counsel, and file an answer to Plaintiff's Complaint. [Dkt. 13.] That deadline has now passed without Defendant's compliance. Accordingly, for the reasons stated previously (see Dkt. 13, 16 ), default is entered against Defendant under Rule 55(a) of the Federal Rules of Civil Procedure. Any motion for entry of a default judgment, with any supporting materials, must be filed on or before 1/6/2025. Within seven days of filing, Plaintiff must (by certified mail, email, or other reliable method) provide Defendant with both a copy of this order of default and Plaintiff's motion for default judgment (if any) and must file proof of service of those documents within three business days. Service may be effected via electronic means in accordance with the Court's previous order. (Dkt. 8 .) A status hearing for tracking purposes is set for 1/29/2025 at 9:00 A.M.
