The plaintiff's written submissions establish that if defendants were informed of this proceeding before a TRO could issue, assets would likely be redirected, defeating plaintiff's interests in identifying defendants, stopping the infringement, and obtaining an accounting. In addition, the submitted evidence establishes a likelihood of success on the merits, the harm to plaintiff is irreparable and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its intellectual property. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective, perhaps the most effective, way to communicate with defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the court will take a fresh look at the asset freeze, joinder, and personal jurisdiction. The Court has recently warned counsel in another case, Case No. 24 C 13140, in which counsel also represents the plaintiff, that he must follow Judge Alonso's case procedures, which are posted on Judge Alonso's webpage on the Northern District of Illinois website at https://www.ilnd.uscourts.gov/judge_display.php?LastName=Alonso, for counterfeit product/Schedule A cases and for filing motions generally. Despite the warning, counsel has again failed to notice his motion for temporary restraining order for a date certain and he has failed to submit clean and redlined versions of his proposed order to the Court's proposed order email inbox. Additionally, when he finally did submit a proposed order in the 13140 case, it deviated without explanation from the template posted to Judge Alonso's webpage, forcing the Court to waste time with judicial editing. If Plaintiff chooses to file a corrected motion for temporary restraining order, he should review the case procedures for counterfeit product/Schedule A cases on Judge Alonso's webpage at https://www.ilnd.uscourts.gov/judge-info.aspx?IuUaWzNcEoNZYybhk1PFH4aOTEZDwGo8 and follow all requirements carefully.
