Jun 17, 2025MINUTE entry before the Honorable Matthew F. Kennelly: The plaintiff and the defendant in this case are both entities incorporated and based in the People's Republic of China. Both apparently sell items on Amazon's online platform. The plaintiff contends that the defendant submitted to Amazon a false claim that a product offered by the plaintiff via Amazon infringes the defendant's patent, which caused Amazon to take down the plaintiff's listing of the product. The plaintiff has moved for electronic service of summons upon the defendant. But before getting to that the plaintiff is ordered to show cause why the case should not be dismissed for lack of personal jurisdiction and venue. On personal jurisdiction, plaintiff alleges that it exists under Fed. R. Civ. P. 4(k)(2) because the defendant purportedly is not subject to jurisdiction in any U.S. state's courts. That seems wrong; if the defendant submitted an infringement notice to Amazon, a U.S.-based company, it likely established a sufficient contact with the state where Amazon is located (likely Washington) to enable a court of that state to assert jurisdiction over the defendant. Regarding venue, it likely exists, if at all, only under 28 USC 1391(b)(3), which requires (a) that there is no district in which venue is otherwise appropriate, and (b) the defendant is subject to personal jurisdiction in the district where the suit is filed (i.e., this District). The latter does not appear to be the case for the reasons just noted. Plaintiff is ordered to show cause in writing by 6/27/2025 why the case should not be dismissed for lack of personal jurisdiction and/or lack of proper venue.
