Oct 2, 2024ORDER: MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff's unopposed motion for relief under FRCP 60(a) 159 is granted. On May 11, 2023, the court severed and stayed certain claims arising from the '924 patent, the '431 patent, the '949 patent, and the '079 patent, and directed that this case would proceed only on Claim 4 of the '949 Patent. Now that the court has resolved Claim 4 of the '949 Patent, the appropriate course would have been to continue the stay on the severed claims to preserve the applicable damages period. Instead, the Court mistakenly closed the case after entering judgment in favor of Defendants following summary judgment. Doing so was an oversight as contemplated by FRCP 60(a), and the Court regrets the error. The clerk is directed to open a new civil action and that action shall be titled Gesture Technology Partner, LLC v. Motorola Mobility, LLC. The Clerk shall assign the case directly to Judge Jenkins as presiding judge and Magistrate Judge Weisman as designated magistrate judge. The Clerk is further directed to docket under the new case number: (1) this Order as Docket Entry Number 1; (2) the Complaint from Case No. 22cv3535 [see Dkt. 1] as Docket Entry Number 2; and (3) the Answer to the Complaint [see Dkt. 18] as Docket Entry Number 3. The Court will separately set a date for the parties to update the Court on the continued need for the stay in light of other proceedings on the remaining patents. This case remains closed.
