Defendant has agreed to be subject to full statutory estoppel for any IPR petitions on the six asserted patents that have already been instituted or filed by other parties. (D.I. 64 ). IPRs have been instituted on two of the asserted patents and filed on the other four (by either Defendant or other parties). (D.I. 37 at 56; D.I. 41 at 5). I gather, from the parties' discussion of the patents as a whole in their briefing, that all asserted claims are challenged in the IPRs or the IPR petitions of their respective patents. The asserted patents expire in about five months. (D.I. 37 at 3). The case is in its early stages, that is, pre-Markman.
