Jan 10, 2025ORDER DENYING 20 MOTION FOR RECONSIDERATION. A Motion for Reconsideration will only be granted where the movant can show: (1) an intervening change in the controlling law; (2) the availability of new evidence that was not available when the court granted the motion... ; or (3) the need to correct a clear error of law or fact or to prevent manifest injustice. United States ex rel. Schumann v. Astrazeneca Pharms. L.P., 769 F.3d 837, 848-49 (3d Cir. 2014). Here, Plaintiff has shown none of the three. Plaintiff does not identify a change in controlling law or newly discoverable evidence. Further, the Court's prior Opinion correctly stated and applied the law. After taking as true the factual content in the Complaint (i.e., the depictions of the accused products and Plaintiff's patents), the Court concluded that the Complaint did not state a plausible claim for relief because a reasonable factfinder could not find that Plaintiff's products and the accused product were substantially the same. Gorham Mfg. Co. v. White, 81 U.S. 511, 513 (1871). The Court's decision was based on the overall appearance of the chairs, not small differences viewed in isolation. The Court properly used prior art to provide the frame of reference for this comparison. Egyptian Goddess, Inc. v. Swisa, Inc., 543 F.3d 665, 676-77 (Fed. Cir. 2008). And the Court correctly dismissed the Complaint with prejudice because no amount of amendment or discovery could cure the Complaint's fatal defect: a reasonable factfinder could not find that Plaintiff's products and the accused product are substantially the same. In its Reply, Plaintiff argues that reconsideration is warranted in light of the Court's failure to sufficiently consider the points of novelty of Plaintiff's design patents. (ECF No. 26 at 8). Given the Federal Circuit's rejection of the point of novelty test, the Court concludes that reconsideration on these grounds would be improper. Egyptian Goddess, 543 F.3d at 678 ([W]e hold that the point of novelty test should no longer be used in the analysis of a claim of design patent infringement. Instead,... we hold that the ordinary observer test should be the sole test for determining whether a design patent has been infringed.).
