Nov 20, 2024MINUTE entry before the Honorable Martha M. Pacold: Plaintiffs' motion for alternative service 6 is granted. An individual may be served "by other means not prohibited by international agreement, as the court orders." Fed. R. Civ. P. 4(f)(3). The court concludes that plaintiffs have made "reasonably diligent efforts to learn the defendant's mailing address." Luxottica Group S.p.A. v. Partnerships & Unincorporated Ass'ns Identified on Schedule "A", 391 F. Supp. 3d 816, 822 (N.D. Ill. 2019). Because the address provided on the patent application did not return a match via either Google or Baidu.com, the court finds that "the address of the person to be served with the document is not known," and thus that the Hague Convention does not prohibit service via email. See Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, Art. 1, Nov. 15, 1965. Nor is service via email prohibited by the Due Process Clause. See Ouyeinc Ltd. v. Alucy, No. 20 C 3490, 2021 WL 2633317, at *3 (N.D. Ill. June 25, 2021) ("In fact, courts have routinely upheld service by email in situations similar to the instant case."). Plaintiff shall serve defendant via email sent to the address indicated in the motion. (rao, ) (Entered: 11/20/2024)PACER Document
