Jun 4, 2025MINUTE ORDER: Plaintiffs 27 Notice of Filing Amended Pleading is STRICKEN as improperly filed and for failure to comply with the Local Rules of Practice. Rule 15 of the Federal Rules of Civil Procedure provides that "[a] party may amend its pleading once as a matter of course" and that, "[i]n all other cases, a party may amend its pleading only with the opposing party's written consent or the court's leave." Fed. R. Civ. P. 15(a)(1), (2). Any attempt to amend as a matter of right is untimely, and further, it appears that Plaintiff already used its one amendment permitted as a matter of right under Rule 15 when it filed its 17 First Amended Complaint for Patent Infringement, as neither the First Amended Complaint nor Second Amended Complaint states that it is filed with Defendant's consent. Should Plaintiff seek leave to amend its First Amended Complaint, it must either file a formal motion or expressly indicate that the amended pleading is filed with Defendant's consent.
