Pursuant to an unopposed motion, on June 5, 2023, the Court stayed this case until the determination of the U.S. International Trade Commission in Investigation No. 337-TA-1361 becomes final. (Order, ECF No. 25.) Notwithstanding the stay, Plaintiff Netgear Inc. filed proofs of service of process effected during the stay, (ECF Nos. 27-28), an amended complaint, (ECF No. 29), and requests for the Clerk to issue summonses on the amended complaint, (ECF Nos. 30-31 ). The Clerk declined to issue the requested summonses. (Notice to Filer of Deficiencies in Electronically Filed Document, ECF No. 32.). The Court strikes all documents filed by Plaintiff since June 5, 2023 because they are contrary to the Court's order staying proceedings. 28 U.S.C. § 1659(a). The Court authorized only status reports and notices to be filed during the pendency of the stay. The Court renders no opinion on the efficacy of service of process during the stay but notes that at least one court in this circuit has concluded that service of process must cease during a§ 1659(a) stay. If Plaintiff seeks to complete service during the stay, it may seek leave of the Court by way of a properly noticed motion or a stipulation signed by all parties who have appeared.
