Aug 16, 2024ORAL ORDER: The Court, having reviewed HP INC.'s Amended Corporate Disclosure Statement (D.I. 47), discloses to the parties that the assigned judge has a standard 401(k) plan that is managed by Vanguard. The 401(k) plan contains several mutual funds owned and/or selected by Vanguard based on criteria set years ago while planning for retirement when the assigned judge was in private practice and before joining the bench. The judge is not aware whether any of the specific mutual funds in his 401(k) plan own stock in HP INC. and does not believe it would affect his ability to be fair and impartial in any event. However, out of an abundance of caution, the Court HEREBY ORDERS the parties to meet and confer and to inform the Court in writing by no later than August 23, 2024 whether Plaintiff and/or Defendant would rather the assigned judge to recuse himself given the potential conflict or whether both parties agree to waive any potential conflict relating to the judge's 401(k) plan with Vanguard.
