The Court generally agrees with defendants that plaintiffs' damages estimate greatly overstates the losses they could incur during the pendency of the stay. Plaintiffs have failed to causally connect most of their supposed prospective losses to defendants' alleged acts of infringement, overstated the length of the stay period in their calculations, and did not include relevant data of their own sales, among other shortcomings. That being said, defendants' analysis somewhat understates plaintiffs' potential damages by focusing on defendants' estimated Lumina sales in the United States during the stay period, ignoring downstream effects of the competitive advantage they may wrongfully gain during that period. After considering both parties' submissions, I determine that the bond amount shall be $1,000,000, which defendants are ordered to post within 14 days from the date of this Order. The parties' 55 and 57 motions to seal are granted, as the Court finds that the parties' interests in maintaining their proprietary business material in a confidential manner outweighs the qualified public right of access. The PTAB's decision to institute review of the asserted patents and the denial of plaintiffs' request for a Director Review demonstrate that defendants' IPR claims are not interposed for the purposes of delay. Because that was the concern animating the Court's decision to require defendants to post a bond, the bond is discharged. The stay shall remain in place throughout the pendency of the IPR proceedings, as the purpose of the stay is to receive the benefit of the PTO's expertise, which will not happen until, at the earliest, the PTAB issues its final written decision.
